Court judgment- Protech Solutions LLC v Mohd Rashid Al Shorouqi (Case No 6 of 2016)

The First Instance Circuit of the Civil and Commercial Court has proceeded to summary judgment in Case No 6 of 2016; Protech Solutions LLC v Mohd Rashid Al Shorouqi. The Claimant, Protech Solutions LLC, a company established in the QFC, brought proceedings against the Defendant, alleging that, in furtherance of a property transaction, the Defendant provided the Claimant with a cheque in the sum of QAR 2,752,000. The Claimant alleged that the cheque was not honoured by the bank and that the Defendant had failed to pay the sum owed. The Court concluded that it was “…satisfied, having read and considered all the documents put before it, that the Claimant has established that there was an agreement between it and the Defendant. Pursuant to that agreement the Defendant agreed to pay the Claimant the sum of QAR 2,752,000. Payment was made by cheque but the cheque was not honoured by the bank. The Defendant acknowledged the same and indicated he would take steps to remedy the matter by issuing a new cheque. He failed to do so. The debt accordingly remains outstanding.” The Court ordered the Defendant to pay the sums owed plus the Claimant’s reasonable costs which are to be assessed by the Registrar.
